2. Terms of Sale
I) CONCLUSION AND TERMINATION OF THE SALES AGREEMENT
These Terms and Conditions, as well as certain terms of sale indicated with information about certain products, represent an offer by FAMILI for the conclusion of a Contract, and the user, as a buyer, by registering, concluding an order or in another manner determined by these Terms and Conditions, accepts them, which is considered to be the conclusion of a Contract between the user and FAMILI, and according to the terms of sale specified in these Terms and Conditions
The subject and commercial purpose of the Contract is the purchase of the selected product via the hascevher.hr web shop with the payment of the appropriate fee - the price of that product. The Contract is concluded by means of distance communication (Contract concluded remotely) and via the Internet.
The Contract enters into force and is binding from the moment the user accepts the offer of FAMILI by filling out an electronic order and making payment via general payment order/transfer/internet banking.
a) In the process of registering or creating a user account, the user is obliged to choose a name or nickname under which they will use the services and choose a security password and provide a valid e-mail address, while FAMILI will confirm and create the b2b account. All data required for registration or creating a user account must be true, and the use or exploitation of other people's data is expressly prohibited.
b) Registration or user account is created for one person only and it is not permitted to communicate registration or user account data to third parties. The user is obliged to keep their security password and user account data confidential. The use of someone else's registration or user account is not permitted.
c) For violation of the provisions of the Terms from this chapter, FAMILI reserves the right, at its discretion, to terminate the user's registration or user account, without the obligation to compensate the user for any costs or damages.
d) Registration (which includes payment for the service) is considered to have concluded an Agreement between FAMILI and the user as a buyer.
e) The Agreement enters into force upon the user's registration, i.e. from the day the user accepts the offer to enter into such an Agreement.
f) The User can unilaterally terminate the Agreement within 14 (fourteen) days without giving a reason.
The deadline for unilateral termination of the Agreement is 14 (fourteen) days from the day when the goods that are the subject of the Agreement were handed over to the user or a third person designated by the user, who is not the carrier, or, in the case of a service, from the conclusion of the Agreement.
The goods for which the contract is terminated must be undamaged and unused, exclusively in their original and undamaged packaging. The return must be agreed in advance and the cost of the return or delivery is borne by the buyer. The goods must be sent to the address FAMILI, Marići 7A, 52220 Labin, Croatia with the indication hascevher.hr web shop return of the goods and attach a written reason for the return.
A copy of the invoice and the Form for Unilateral Termination of the Contract must be attached to the goods that meet the refund of the paid funds.
In order for the user to exercise the right to unilateral termination of the Contract, he must inform FAMILI of his decision to unilaterally terminate the Contract before the expiration of the deadline, by an unambiguous statement sent by e-mail to info@famili-shop.hr, in which he will state his name and surname, address, telephone number, e-mail address and order number, and he can also use the written Form for Unilateral Termination of the Contract (download PDF file).
Also, the user can fill out the Form for Unilateral Termination of the Contract electronically and send it to info@famili-shop.hr, in which case FAMILI will send him a confirmation of receipt of the notification of unilateral termination of the Contract by e-mail without delay.
If the user unilaterally terminates the Agreement, the money received from him, but reduced by the delivery costs that were valid at that time, will be refunded to him without delay, and no later than 14 (fourteen) days from the day when FAMILI receives the user's decision to unilaterally terminate the Agreement. The refund will be made in the same way as the user made the payment. FAMILI can only refund the money after the goods have been returned to him and it has been verified that there is no damage that occurred after the goods were handed over to the user or a third party designated by the user, who is not the carrier.
The user is responsible for any decrease in the value of the goods resulting from the handling of the goods, except for that which was necessary to determine the nature, characteristics and functionality of the goods.
If, at the user's request, the performance of the service has begun during the period for unilateral termination of the Agreement, the user is obliged to pay FAMILI an amount that is proportional to what was delivered up to the moment the user notified FAMILI of the unilateral termination of the Agreement.
The User does not have the right to unilaterally terminate the Agreement:
in cases prescribed by the Consumer Protection Act: goods made to the buyer's specifications, perishable goods or goods that expire quickly, sealed goods that are not suitable for return due to health or hygiene reasons, if they were unsealed after delivery, etc. Complete information regarding the buyer's right to unilaterally terminate the contract can be found in the Consumer Protection Act.

II) TERMS AND CONDITIONS AND PURCHASE PROCEDURE
The main characteristics of the product, method of use, prices, special promotions and benefits, payment and delivery methods refer to those valid at the time of the order. The specified data will be indicated with each product.
The price of the product, including VAT and delivery costs, is visible in the shopping cart before the order is completed. The delivery cost may also be visible in some other parts of the site. All information about the purchase confirmation based on an electronic order will be delivered to the buyer's email address specified in the registration/order process or in the shopping cart when entering data when completing the order. All prices are expressed in euros (EUR). All prices include VAT.

III) DELIVERY AND DELIVERY CONDITIONS

IV) COMPLAINTS AND OBJECTIONS
The ordered products are packed in such a way that they are not damaged by normal handling during transport/delivery. The buyer is obliged to inspect the packaging of the shipment when taking it over. If the packaging of the shipment has visible damage/flaws, we recommend that the customer refuse to accept it, as there is a possibility that the product inside such packaging is damaged. By rejecting the receipt, the delivery service will return the parcel to FAMILY, with a note that the parcel contains a defect.
Complaints related to product defects and all other objections can be submitted in writing via electronic mail to the e-mail address info@famili-shop.hr.
In the case of a justified complaint, it is possible to terminate the contract with a refund of the amount paid or product replacement. If it is about damage and/or defectiveness of the delivered goods, the customer should send a photo of the said complaint so that it can be accepted on the basis of physical evidence. Damaged and defective goods can be returned to FAMILI, Marići 7A, 52220 Labin, Croatia with the indication FAMILI web shop return of goods.
In the event of a dispute regarding the justification of the complaint and/or the manner in which the product was returned (the product must be unused, in unchanged quantity and in the original packaging, with the original invoice and warranty - if any, and all other accessories that come with it) the product will be submitted for expert assessment to an expert or a professional legal entity. In the event that the expert assessment determines the justification of the complaint, all costs of replacing or repairing the product will be borne by FAMILI, in the event of an unjustified complaint, the cost will be borne by the buyer.
The seller is liable for material defects in accordance with applicable regulations, especially the Civil Obligations Act of the Republic of Croatia.
V) WARRANTY FOR THE CORRECTNESS OF THE PRODUCTS SOLD AND SERVICE
The products for which we provide a guarantee in accordance with the law and the guarantee specified by the manufacturer have a warranty certificate. The right to use the warranty is exercised upon presentation of the original invoice and warranty certificate. The buyer is obliged to keep the warranty certificate and invoice. The date of issue of the invoice is the date of commencement of the warranty
In the case of issuing a warranty certificate by which the manufacturer guarantees the correctness of the product for a certain period of time, the buyer may, if the product is not correct, request that the product be repaired within a reasonable time or that another such correct product be handed over instead of repair. If a product malfunction occurs during the warranty period, it shall be delivered to an authorized service center specified in the warranty certificate.
Product malfunctions resulting from improper use and/or failure to comply with the instructions are not covered by the warranty. Servicing and sale of replacement parts for the purchased product are provided through authorized service centers specified in the warranty certificate.
VI) PAYMENT METHOD AND PROCEDURE
Payment of the product price and delivery costs can be made in the following way:
a) Payment by general payment order
Products for which an order has been concluded can be paid for via general payment order at all bank branches, FINA or Croatian Post offices. After confirming the order, FAMILI will send an offer for the created order to the buyer's e-mail address, with the specified data required for payment. All data must be entered correctly and the payment must be made within the deadline.
b) Payment by internet banking
Products for which an order has been concluded can be paid for via internet banking of any bank that offers this payment method. After confirming the order, FAMILI will send an offer for the created order to the buyer's e-mail address, with the specified data required for payment. c) Payment by bank transfer
